Abstrak: Penelitian ini bertujuan menganalisis kualifikasi yuridis kelalaian pengemudi yang merokok saat berkendara dalam perspektif hukum positif Indonesia, serta mengkaji bentuk pertanggungjawaban pidana dan perdata yang dapat dikenakan apabila perbuatan tersebut menimbulkan kecelakaan. Penelitian menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan konseptual. Bahan hukum yang dianalisis meliputi Kitab Undang-Undang Hukum Pidana, Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan, serta doktrin mengenai culpa dan perbuatan melawan hukum. Hasil penelitian menunjukkan bahwa meskipun merokok saat berkendara tidak diatur secara eksplisit sebagai larangan khusus, perilaku tersebut dapat dikualifikasikan sebagai bentuk kelalaian (culpa) apabila terbukti mengganggu konsentrasi dan memiliki hubungan kausal dengan terjadinya kecelakaan. Pertanggungjawaban pidana dapat dikenakan berdasarkan Pasal 310 UU LLAJ dan ketentuan kelalaian dalam KUHP, sedangkan tanggung jawab perdata dapat diajukan melalui mekanisme gugatan perbuatan melawan hukum berdasarkan Pasal 1365 KUHPerdata. Penelitian ini juga menemukan adanya kesenjangan antara norma dan implementasi, terutama dalam aspek pembuktian, konsistensi penegakan hukum, serta kesadaran hukum masyarakat. Oleh karena itu, diperlukan penguatan regulasi teknis, optimalisasi instrumen pembuktian berbasis teknologi, serta pendekatan preventif guna meningkatkan perlindungan korban dan efektivitas hukum lalu lintas.
Abstract : This study aims to analyze the juridical qualification of driver negligence when smoking while driving from the perspective of Indonesian positive law, as well as to examine the forms of criminal and civil liability that may be imposed if such conduct results in an accident. The research employs a normative legal method with statutory and conceptual approaches. The legal materials analyzed include the Indonesian Criminal Code, Law Number 22 of 2009 concerning Road Traffic and Transportation, as well as doctrines on negligence (culpa) and unlawful acts.
The results show that although smoking while driving is not explicitly regulated as a specific prohibition, such behavior can be qualified as a form of negligence (culpa) if it is proven to interfere with concentration and has a causal relationship with the occurrence of an accident. Criminal liability may be imposed based on Article 310 of the Road Traffic and Transportation Law and negligence provisions in the Criminal Code, while civil liability may be pursued through a lawsuit for unlawful acts under Article 1365 of the Civil Code.
This study also finds a gap between norms and implementation, particularly in aspects of evidentiary proof, consistency of law enforcement, and public legal awareness. Therefore, strengthening technical regulations, optimizing technology-based evidentiary instruments, and adopting preventive approaches are necessary to enhance victim protection and the effectiveness of traffic law.
